1. Content Authenticity Guarantee

SongBiz guarantees that all custom song videos are:

  • Performed by a real human artist (no AI-generated vocals or deepfakes)
  • Recorded specifically for your order (no pre-recorded stock performances)
  • Original content created by the artist
  • Verified through advanced AI content moderation

🛡️ AI Verification: Every uploaded video is automatically scanned for AI-generated content, deepfakes, stock footage, inappropriate content, and authenticity. Videos must pass validation before delivery.

2. Content Safety & Guidelines

All videos are scanned and must comply with:

  • No Inappropriate Content: Nudity, sexual content, violence, hate speech, illegal activities
  • No Offensive Material: Discriminatory, harassing, or threatening content
  • No Copyright Violations: Unlicensed covers or copyrighted music (original songs only)
  • No Misleading Content: Videos must accurately represent the artist's performance
  • No Dangerous Activities: Content promoting self-harm, dangerous stunts, or illegal behavior

⚠️ Rejection Policy: Videos that fail AI moderation will be rejected immediately. Artists will be notified with specific reasons and given one opportunity to re-upload compliant content.

3. Social Media Sharing Restrictions

Artists can choose to restrict social media sharing for privacy reasons.

When Sharing is Restricted:

  • ✓ You receive a private, personalized video for personal use only
  • ✓ You may NOT post, share, or distribute the video on any social media platform
  • ✓ You may NOT use the video for commercial purposes
  • ✓ You MAY share privately with the video recipient and immediate family
  • ✓ You MAY download and save the video for personal viewing

Legal Agreement: By accepting a restricted video, you agree not to share it publicly. Violation may result in legal action and permanent ban from the platform.

When Sharing is Allowed:

  • ✓ You may share the video on your personal social media accounts
  • ✓ You must credit the artist: "Custom song by [Artist Name] via @SongBizPro"
  • ✓ You may NOT use for commercial advertising without artist permission
  • ✓ You may NOT claim the music as your own creation
  • ✓ You may NOT re-sell or license the video to others

4. Artist Responsibilities

Artists agree to:

  • Deliver an authentic, personally performed video (no AI, no stock footage, no lip-sync)
  • Record video specifically for the customer's order
  • Include personalized elements from the customer's story
  • Maintain professional and appropriate content standards
  • Meet agreed-upon deadlines or accept automatic refund
  • Provide clear audio and video quality
  • Show face in video to confirm authenticity (unless artistic choice)

⚖️ Legal Record: Your IP address and upload timestamp are recorded for legal protection. By uploading, you certify the video is your original work and complies with all guidelines.

5. Customer Responsibilities

Customers agree to:

  • Provide accurate, non-offensive information for the song
  • Respect artist's sharing restrictions if applicable
  • Not request inappropriate, offensive, or illegal content
  • Have permission to share any names or stories included in requests
  • Approve or request revision within 72 hours of delivery
  • Use video in accordance with license scope selected

6. Payment & Refund Policy

Payment is held in escrow until delivery is approved:

  • Deadline Met + Approved: Payment released to artist within 2-7 business days
  • Deadline Missed: Automatic full refund issued to customer
  • Content Rejected (AI Moderation): Artist has one chance to re-upload; if deadline passes, full refund
  • Customer Disapproves: ONE free revision allowed (if within max revisions limit)
  • 72-Hour Silence: Order auto-completes, payment released to artist

💰 Platform Fee: SongBiz retains 15% as a platform fee. 85% of payment goes to the artist.

7. Intellectual Property

License Grant:

  • Artist Retains Copyright: The artist owns all rights to the original musical composition and performance
  • Customer License: You receive a non-exclusive, non-transferable license to use the video as specified
  • Personal Use: Use for personal enjoyment, sharing with recipient and family
  • Online Use (if selected): Post to personal social media with artist credit required
  • Prohibited Uses: Commercial advertising, re-selling, claiming as your own work, licensing to third parties

8. Privacy & Data Protection

We protect your privacy:

  • Videos are stored in secure, private storage with signed URLs
  • Download links expire after 90 days (download your video within this period)
  • Personal information (names, stories, emails) is encrypted
  • IP addresses are logged for legal protection only
  • Artist and customer communication is private and moderated
  • Videos are not publicly indexed or searchable

9. Dispute Resolution

If there's an issue:

  • Step 1: Contact artist through the platform messaging system
  • Step 2: Request revision if within revision limit
  • Step 3: Contact SongBiz support at cheston@songbizpro.com
  • Step 4: SongBiz will review AI validation logs, communication, and video
  • Final Decision: SongBiz reserves right to issue refund or release payment based on evidence

10. Platform Rights

SongBiz reserves the right to:

  • Reject or remove content that violates guidelines
  • Suspend or ban users who violate terms
  • Update AI moderation algorithms and policies
  • Mediate disputes between artists and customers
  • Refund orders if content validation fails
  • Modify these terms with 30 days notice

11. Legal Disclaimers

  • No Guarantee: While we verify authenticity, we cannot guarantee the artistic quality or emotional impact of performances
  • Third-Party Content: Artists are responsible for ensuring their performances don't violate copyright or trademarks
  • Platform Not Liable: SongBiz is a platform connecting artists and customers; we're not liable for the content itself
  • Use at Own Risk: Customers use videos at their own discretion and risk
  • Governing Law: These terms are governed by laws of the United States
